Terms of Service

Last updated: [date]

Draft — not yet legally reviewed. Have this reviewed by a South African attorney and fill in the placeholders before relying on it with real practices and clients.

1. Acceptance of these terms

By creating an account or using Oriva OS (the "Service"), you agree to these terms. If you don't agree, please don't use the Service.

2. What the Service is

Oriva OS is white-label software that lets a health practice ("Practice") manage nutrition and wellness for its own clients — meal plans, food and wellness logging, an AI Coach, recipes, messaging, and booking. Each Practice operates under its own branding but runs on shared underlying infrastructure operated by [your business name].

3. Not medical advice

Oriva OS is a tool to support a health practitioner's work — it does not replace professional medical, dietetic, or psychological judgment. The AI Coach and auto-generated meal plans are generated by software and can be wrong. In particular:

4. Accounts

You're responsible for keeping your login credentials confidential and for all activity under your account. You must provide accurate information, including any allergies or exclusions you rely on the Service to act on.

5. Practitioners

If you use the Service as a practitioner, you're responsible for the professional care you provide to your clients, for reviewing anything the Service generates before a client relies on it, and for complying with the rules of your own professional body and applicable law (including South Africa's POPIA in respect of your clients' data).

6. Clients

If you use the Service as a client, you're responsible for the accuracy of the health information you provide, and for using your own judgment — alongside your practitioner's guidance — about what you eat and how you use the Service's recommendations.

7. Payment and subscriptions

Some features may require payment now or in the future, whether billed through the Service or arranged directly with your Practice. Billing terms, if any apply to you, will be made clear at the time.

8. Acceptable use

Don't use the Service to harass others, upload content you don't have the right to share, attempt to access another Practice's data, or interfere with the Service's normal operation.

9. Content and ownership

A Practice retains ownership of the recipes, notes, and other content it creates. Content marked as shared/"commons" may be used by other Practices on the platform. You grant us the right to host and process your content solely to provide the Service.

10. Termination

You may stop using the Service and request deletion of your account at any time from your Account page. We may suspend or terminate access for a violation of these terms.

11. Disclaimers and limitation of liability

The Service is provided "as is" without warranties of any kind. To the fullest extent permitted by law, [your business name] is not liable for indirect, incidental, or consequential damages arising from use of the Service, including any health outcome resulting from reliance on a generated meal plan, the AI Coach, or ingredient-swap suggestions without independent verification.

12. Governing law

These terms are governed by the laws of South Africa.

13. Changes to these terms

If we make material changes, we'll update the date at the top of this page.
